Ministry of National Defense press release

The Ministry of National Defense says today (31^st ) that it wishes to elaborate on the incident where “a discharged former comrade expresses his opinion regarding the Ministry’s administrative appeal statement of defense he received”.

Ⅰ. The Ministry of National Defense handles all administrative appeals according to the Administrative Appeal Act. The person in question has the right to file an administrative appeal within 30 days upon the receipt of discharge compensation notice issued by the Ministry of National Defense to the Executive Yuan’s Administrative Appeal Review Commission. By law the MND shall make a written statement according to the content of administrative appeal and law provisions and complete a statement of defense before submitting it to the Executive Yuan, and sending a copy to the person in question.

Ⅱ. Any statement in the Ministry of National Defense’s statement of defense that refers to the original words of the Justice’s interpretation of the constitution and is quoted as “the Judicial Yuan…” is an excerpt of the interpretation of the Judicial Yuan.

Ⅲ. Once the Executive Yuan receives the Ministry of National Defense’s statement of defense, a review will be held according to law by the Administrative Appeal Commission, where a decision will be made. The Ministry of National Defense carries out further actions based on the results of such administrative decisions of the Executive Yuan. This is why that, the Ministry of National Defense wishes to hereby clarify, the statement of defense copy the Ministry of National Defense issued to the person who filed for an administrative appeal is not the final administrative appeal decision made by the Executive Yuan.
